Terms of Service
1. Agreement to Terms
By accessing or using the Ember application and emberfamily.app website (the "Service"), operated by The Atlas Elevated Company ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Ember is a family emotional intelligence platform that provides daily check-ins, AI-powered insights, sentiment analysis, and guided family communication tools. The Service uses artificial intelligence to process emotional data and generate actionable insights for families.
3. Eligibility
You must be at least 18 years old to create an Ember account. Children under 18 may use Ember only through a parent or legal guardian's account, with age-appropriate features as determined by the parent.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, complete information. You agree to notify us immediately of any unauthorized access to your account.
5. Subscriptions & Payment
Free Trial: New users receive a 7-day free trial of Ember Pro features. No credit card is required to start the trial. After the trial period, access reverts to the free Ember Starter tier unless you subscribe.
Paid Plans: Ember Pro and Ember Premium are available as monthly or annual subscriptions. The Founding Member plan is a special annual subscription with a locked price. All prices are in USD.
Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually). Payment is processed by Stripe, Inc.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Price Changes: We may change subscription prices with 30 days' notice. Founding Member pricing is locked and will not increase for the life of the subscription.
6. AI-Generated Content
The Service uses artificial intelligence to generate Daily Briefs, Sentiment Alerts, Conversation Starters, and other insights. This AI-generated content is provided for informational and conversational purposes only. It is not a substitute for professional mental health advice, therapy, or counseling. If you or a family member is experiencing a mental health crisis, please contact a qualified professional or call 988 (Suicide & Crisis Lifeline).
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access other users' data or accounts
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to harass, abuse, or harm any person
- Submit false or misleading information
- Use automated systems to access the Service without permission
8. Intellectual Property
The Service, including its design, features, content, and branding, is owned by The Atlas Elevated Company. Your check-in data and personal content remain your property. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED INSIGHTS MAY CONTAIN INACCURACIES AND SHOULD NOT BE RELIED UPON AS PROFESSIONAL ADVICE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ATLAS ELEVATED COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM RELIANCE ON AI-GENERATED INSIGHTS.
12. Indemnification
You agree to indemnify and hold harmless The Atlas Elevated Company from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with notice. Upon termination, your right to use the Service ceases immediately, but you may request export of your data within 30 days.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
